Holmes Genealogy Research in Ayrshire

The following are my notes compiled while researching Holmes families in Ayrshire. I am sharing these in an effort to help other researchers. References are provided as to where I obtained the material. Much of the material are transcriptions of testamants. These are my best attempt to decipher the old Scottish script and are full of gaps (….) where I could not make out the text. Please forgive these and any errors.

13 May 1522. #557 – Instrument narrating that Alexander Kennedy of Bargany freely resigned in the hands of John Kennedy, one of the bailies of Are, in favour of Thomas Kennedy, goldsmith, the following annual rents, 5s. from the tene- ment of the late Alexander Fa in said burgh, between the tene- ment of the late John Chapman on the north, and the common vennel on the south; 135. 4d. yearly from a tenement of the late John Thomson, between the tenement of John Broun on the south, and that of Thomas Walker on the north ; 40s. yearly from the back tenement of Robert Stensoun, between the tenement of John Johnson on the west and that of the late Hugh Housone on the east; 4s. from the tenement of William Walker back and fore, between John Broun’s tenement on south and that of John Campble on north ; 26s. from the tenement of John Mure, between the tenement of the late Robert Clerk on the west and that of James Kennedy on the east; 55. from the tenement of the late Nigel Wilzemsone, between the tenement of George Chalmer on the west and that of Matthew Holmis on the east; 50s. from the back tenement of the late John Lokart, mason, between the tenements of John Fullarton on the south and of the Provost of Maybole on north ; 155. from the tene- ment of James Curry, between the tenements of William Ker on south and of the late Alexander Campble of Skerintone on the north ; 8s. from the late Alexander Campble’s tenement, between James Curry’s on the south and that of Thomas Dalrimple on the north ; 135. 4d. from the tenement of Thomas Thomsoun, between the tenements of James Thomsoun on the north and of John Wilsoun on south ; and ios. from the tenement of the late George Nesbyte, between the tenement of the late Allan Mungumbry on the south and that of Thomas Dalrimple on north ; upon which resignation Thomas K. asked instruments. Oct 1524. #712 – Instrument narrating that Adam Wallace, alderman, with Thomas Broune and Richard Rede, baillies of Are, in the Tolbooth, sitting as a court, publicly produced in court a royal commission under the quarter seal, obtained and specially directed to said alderman and bailies for punish- ing thieves, robbers and transgressors found within the burgh; which commission the alderman and bailies accepted upon themselves and gave their oath to put the same to execution in all points, and to that effect they created members of their court, namely, Alexander Rathe, clerk and scribe, Matthew Holmes (“sectator”), and Patrick Merchel, John Cunigham, Alexander Mortoune and Nicholas Colquhoun, sergeants, for the execution of the commission, and gave their oaths for faithful ministration in their offices. 20 Mar 1530. #1128. Instrument narrating that Leonard Clerk or Aldhale, one of the bailies of Air, gave sasine and possession of a tenement, fore and back, with yard and pertinents, lying in the burgh of Air, between the tenement of the late George Kennedy of Attiquin on the east and the tenement of William Holmis on the west, to Hugh Campble of Lowdoun, sheriff of Air, as son and lawful and nearest heir to the late Hugh Campble of Lowdoun, knight, to be held of the king in manner of burgage. Done on the ground of the tenement 20 March 1530. Witnesses, James Campbell George Richard Bannatyne and George Craufurd, 136a. (Protocol Book of Gavin Ros, p.204)
Jul 1531 #1186. Instrument narrating that Richard Banatine, burgess of Air, constituted and named James Banatine, his son, as his lawful assignee in and to the sum of 40 merks money lying upon a tenement of Hugh Campble of Lowdoun, situated in the burgh of Air, between the tenement of the late George Kennnedy of Antiquin on one side and that of the late Matthew Holmis on the other side, alienated to the said Richard for the above sum. With the usual powers of an assignee. Same date as preceding, 157a (Protocol Book of Gavin Ros, p.213)
Dates 31 Oct 1582 Instrument of Sasine under the hand of John Masoun, clerk of the diocese of Glasgow, notary public, narrating that James Bannatyne, one of the bailies of the burgh of Air, passed to the lands aftermentioned, and there gave sasine to James Campbell, as lawful and nearest heir of Donald Campbell, burgess of Air, his father, of (1) a tenement of land, back and fore, with yard and pertinents, formerly the property of Hugh Campbell of Lowdoun, lying in the said burgh, between the tenement of Matthew Holmis and of the said Donald Campbell, now of Thomas Padene, on the west, and the tenement of the late George Kennedy of Attiquyn and of the late Thomas Kennedy now of James Kennedy, his son, on the east and (2) a back tenement of the late Leonard Cochrem lying in the said burgh, between the tenement of the said Donald Campbell on the west and north, another tenement formerly belonging to him, now to Thomas Padene, on the east, and the fore-tenement of Robert Rankene on the south, with free ish and entry by the fore-gate of the said fore-tenement of the said Robert Ranken to the said back tenement. May 1718. Council Records. Will: Holmes listed as member of the community (ACR, p.156)
6 Oct 1722. James Gilespy Weaver in Ayr gave in a supplication to the Magistrate and council representing that on the 24 Feb … and five years & was admitted Burgess and freeman of this burgh by right of umquile Elizabeth Galloway then his spouse, daughter to the deceased William Galloway weaver in Ayr and payed three pounds… but it being suggested that the said Elizabeth Galloway was only second daughter and therefore had not to right to the freedom… also that the the said Elizabeth Galloway was not eldest yet was full daughter to the said William Galloway and that since her decease .. had married Annabell Holmes daughter to umquile Robert Holmes weaver of Ayr who was burgess and freeman … Magistrates and Council aforesaid consented and agreed that the said James Gilespy should be admitted and Recorded Burgess and freeman (Ayr Council Records, p.22)

55. Notarial Instrument narrating that on the date hereof in presence of Mathew Campbell in Terrynzane, sheriff of Ayr, in his court in the courthouse of Ayr, there appeared John Montgomery, brother of Hugh Earl of Eglinton, Bailie of Cuningham, and John Montgomery, bailie of the burgh of Irvine, bailie depute of Cuningham, who requested in the first place, that Robert Boyman, John Gardner, and John Galstone, dependan’s of the said bailie, accused of stealing two oxen from Robert Lyndesay and Elizabeth Holmys residing in Dreghorn Cuningham, and Caprington, should be repledged to the court of the bailiary of Cuningham, because the alleged theft was committed within his jurisdiction of Cuningham; which sheriff proceeded to try the theft: Wherefore the bailies depute protested that this process should not prejudice the bailie of Cuningham or his privilege. Then secondly, the said bailie of Irvine on behalf of his said dependants, declared that the sheriff ought not to proceed in the said cause, because his clients had seized the two oxen for fines due to the King from Dreghorn Cuningham and Peirston Cuningham, and for which the bailie of Cuningham himself had been exonered in exchequer and had asked a term for the production thereof; wherefore the bailie depute protested that nothing done in the accusation should prejudice his clients. Done on 31 July 1509. Present John Schaw of Haly, David Crawfurd of Kers, Robert Conigham of Conyhamheid, and Archibald Maxwell. On the 7th February following the matter above referred to was brought before the Privy Council and judgment was given against the Sheriff of Ayr and his assize for proceeding in the cause to the prejudice of the Bailie Court of Cuningham. Notarial protest by John Montgombry, brother of Hugh, Earl of Eglinton and baillie of Cunningham, and John Montgumbry, baillie of the burgh of Irvine, deputes of the foresaid bailliary of Cunningham, in the presence of Matthew Campbell in Terynzane, sheriff of Ayr sitting in judgement, that Robert Boyman and John Gardner dwelling in the said bailliary, who had been accused of the theft of two oxen from Robert Lyndesay and Elizabeth Holmys, dwelling in Dreghorn, Conighame and Capronstoun, and who had been repledged to the court of the said bailliary and were subject to its jurisdiction should not be tried by the said sheriff. In the year 1616, on the 16th day of January, there compeared personally an honourable man, Allan Dunlop, one of the bailies of the burgh of Irvine, upon the ground of the tenement of land undermentioned, and there, in virtue of authentic documents publicly shown and read, gave state, sasine, and possession to Alexander Baillie, as son and heir of the late Martin Baillie, burgess of the said burgh, of that tenement of land, fore and back, with yard, dyke, etc. , lying within the said burgh, on the east side of the High Street thereof, between the tenement formerly of Robert Montgomerie, burgess, and now of John Kennedy, on the north, the tenement of Alexander Gray, cutler, and of Jonet Rankein, on the south, and the meadow on the west : holding of the king in burgage manner : Moreover, the said Alexander Baillie, being upon the ground, for certain sums of money paid to him beforehand by a prudent man, William Cauldwell of Annanhill and Jean Dunlop his spouse, and also in terms of disposition granted by him with consent of Allan Steinsoun in Mylnetoun, William Steinsoun in Craig, and Hugh Holmes in Dreghorn, at whose instance the granter was interdicted, did purely and simply resign the said tenement in the hands of the said Allan Dunlop, bailie, for new infeftment of the same to be given to the said William Cauldwell and Jean Dunlop in conjunct fee, and to the heirs procreated between them, which failing, the heirs and assignees of the said William heritably : Whereupon the said bailie gave sasine accordingly by delivery of earth and stone of the tenement to the said William and Jean, personally present and accepting thereof : Done upon the said ground about the fourth hour after noon of the aforesaid day, in presence of these witnesses, Adam Cunynghame, merchant burgess of Irvine , John Wilson, messenger, William Greiff, burgess, and Oliver Broun, serjeant. “the Session ordaines that non build houses upon the Kirk yaird dyk, except they draw tacks from the Sess, according to ane former Act of Sess., January 15, 1662.”. This reassertion of the Act resulted only as follows : on the 22nd of July, John Moor, James Holmes, and John Gemill were cited to “the nixt Sess, to mak payment of 6sh. 8d., each one of them yearely, the space of twelve yeares, for their priviledg in getg leave to build their houses vpon the Kirk yaird dyk, and to pay accordingly henceforth.”
November 4th saw the appointment of the Laird of Rowallane as “Civil Mag. in the sd Sess.,” several members of which were then appointed, “to crave in the rents of John Moor, James Holmes, and John Gemill, for their priviledges of the Kirk yard dyk,” etc. The orthography of the Session meetings varies with different writers, but that the facts are truly recorded, not a shadow of doubt crossed my mind. 18th November 1674, “ the Session appointed the Laird of Rowallane, John Gemill, David Gewill, William Hendrie, Thomas Whyte, James Kirkland, John Thomsone, to convene at the Minister, his house, vpon Monday next, to revise the minutes, the year past, and to see and hear them written into the Sess. Book.“ The practice of going to the border of England, and getting married there, had a disturbing effect on the Session ; thus at the meeting of December 16th, “as also of their vnorderlie and scandalous going about their marriage, in going to the border of England, so that it questioned whither they be married or not, ffor qch the sd Jonet is a pointed to cum to the publiek place of repentance,” etc.

Notarial Instrument, narrating that a prudent man, William Cauldwell of Annanhill, clerk of the bailiery of Cunynghame, procurator lawfully constituted, in name of Mr. Robert Scott, one of the ordinary ministers of the city of Glasgow, and Esther Flemyng his spouse, compeared personally in presence of the notary and witnesses, and resigned all and whole these lands, namely, First, those nine roods of land lying between the tenements and land sometime belonging to the late Stephan Robesoun, but now to Patrick Kyll, on the north, and the Templar tenement of Mr. Hugh Tran on the south : Second, those two acres of land lying between the said Templar tenement on the north, and the lands of the late William Robesoun on the south : Third, that one acre of land lying between the lands of the late on the north, and the lands of the Laird of Gaitgirth on the south : Fourth, those nine roods of land lying between the lands of Robert Cunynghame on the south, and the lands of John Peibles of Knodgerhill on the north Fifth, that one rood of land lying below Patoune’s Thorne, between the lands of Stephan Boyd on the south, and the lands of the said John Peibles on the north : Sixth, that acre or rig of land lying between the lands of Deine on the south, and the lands of William Patoun on the north : Seventh , that piece of rig lying between the lands of the late Thomas Tran on the north , and the tenement of William Holmes on the south, all lying within the territory of the burgh of Irvine, in the hands of an honourable man, Allan Dunlop, one of the bailies of the said burgh, in favour of and for new infeftment to be given to a prudent man, Hugh Thomsoun, burgess of Londonderry, in the kingdom of Ireland , his heirs and assignees : Which resignation having been duly made, and by the said bailie admitted and received , the said Allan Dunlop, bailie, by virtue of his office, and on the special mandate and request of the resigner, did, with his own hands, give state and sasine of the lands above recited , singly and successively, to the said Hugh Thomsoun, personally present and accepting, according to the tenor of a disposition granted to him by the said Mr. Robert Scott and his spouse : To be holden of the King burgage, for the usual fermes and duties : Moreover, the said Hugh Thomsoun, for the singular love and favour which he had and bare towards his beloved spouse, Bessie Erskyne, did freely resign all and whole the lands aforesaid in the hands of the said bailie, for new sasine thereof to be given to himself, the said Hugh, and Elizabeth Erskyne his spouse, and the survivor of them, in conjunct fee, and the heirs lawfully gotten or to be gotten between them, which failing, to the heirs and assignees whatsoever of the said Hugh. Sasine was thereupon given accordingly to the said Hugh Thomsoun, and to John Dunlop, one of the newest bailies of the said burgh, as attorney for the said Elizabeth Erskyne. Notarial Instrument narrating that an honourable man, John Peiblis of Knodgerhill, béing personally, in presence of the notary and witnesses, on the ground of those five roods of land belonging heritably to him, lying within the territory of the burgh of Irvine, at the head thereof, on the west side of the way or common thoroughfare leading from the head of the said town to the Water of Annok, between the lands of the late William Scott, provost of the said burgh, but now of Hugh Thomson, on the east, and the lands of the late Stephan Boyd on the west and there the said John Peiblis did spontaneously and freely resign the said lands in the hands of an honourable man, Allan Dunlop, one of the bailies of the said burgh, in favour of and for new sasine to be given to a prudent man, Henry Dyett, smith, burgess of Irvine, and that in terms of contract of sale between the resigner and him : which resignation being so made, duly and lawfully, and by the said bailie received, he, the said Allan Dunlop, did with his own hands give state and sasine of the said roods to the said Henry Dyett, personally present and accepting the same, by delivery of earth and stone of the ground thereof : whereupon the said Henry, for the singular love and favour which he had and bare towards his beloved spouse, Jonet Holmes, did resign the said five roods again in the hands of the bailie aforesaid , in favour of himself, the said Henry, and of Jonet his spouse, for new sasine to be given to them in conjunct fee, and to the survivor of them, and the heirs lawfully gotten or to be gotten between them ; which failing, to the heirs and assignees of the said Henry which was accordingly done : the said lands holding of the king burgagewise : these things were done on the ground of the lands about the third hour after noon of the 19th day of January 1616 , in presence of these witnesses, William Mure, one of the newest bailies of the said burgh, William Dyett younger, smith, Edward Cowan and Alexander Paton, burgesses, and John Boyd, officer.

In the year 1616, on the 16th day of January, there compeared personally an honourable man, Allan Dunlop, one of the bailies of the burgh of Irvine, upon the ground of the tenement of land undermentioned, and there, in virtue of authentic documents publicly shown and read, gave state, sasine, and possession to Alexander Baillie, as son and heir of the late Martin Baillie, burgess of the said burgh, of that tenement of land, fore and back, with yard, dyke, etc. , lying within the said burgh, on the east side of the High Street thereof, between the tenement formerly of Robert Montgomerie, burgess, and now of John Kennedy, on the north, the tenement of Alexander Gray, cutler, and of Jonet Rankein, on the south, and the meadow on the west : holding of the king in burgage manner : Moreover, the said Alexander Baillie, being upon the ground, for certain sums of money paid to him beforehand by a prudent man, William Cauldwell of Annanhill and Jean Dunlop his spouse, and also in terms of disposition granted by him with consent of Allan Steinsoun in Mylnetoun, William Steinsoun in Craig, and Hugh Holmes in Dreghorn, at whose instance the granter was interdicted, did purely and simply resign the said tenement in the hands of the said Allan Dunlop, bailie, for new infeftment of the same to be given to the said William Cauldwell and Jean Dunlop in conjunct fee, and to the heirs procreated between them, which failing, the heirs and assignees of the said William heritably : Whereupon the said bailie gave sasine accordingly by delivery of earth and stone of the tenement to the said William and Jean, personally present and accepting thereof : Done upon the said ground about the fourth hour after noon of the aforesaid day, in presence of these witnesses, Adam Cunynghame, merchant burgess of Irvine , John Wilson, messenger, William Greiff, burgess, and Oliver Broun, serjeant. Instrument narrating that a worthy woman, Margaret Cunynghame, wife of Adam Cunynghame, one of the last bailies of the burgh of Irvine, compeared personally upon the ground of that tenement of land, formerly pertaining heritably to the deceased Janet Holmes, her daughter, lying within the said burgh, on the east side of the High Street of the same, near the market cross of the said burgh, between the tenement formerly of the late David Cunynghame, now of Andrew Calderwood, called Saint Conwell’s Walls, on the south, and the tenement of the late Alexander Mitchell, but now of his heir, and of John Gottray, on the north: And there the said Margaret, having and holding in her hands a certain precept of seizin, sealed with wax, from the chancery of our sovereign lord the king, directed to the provost and bailies of the burgh of Irvine, for giving seizin to the said Margaret, as lawful and nearest heir of the said Janet Holmes, her daughter (by reason of provision); which precept she, with all due reverence, presented to an honourable man, Allan Dunlop, one of the bailies of the said burgh, humbly requesting him to put the same to due execution; and the bailie, having received the precept from the hands of the said Margaret, delivered it to the notary public, to be read, published, and explained by him to the bystanders in the vulgar tongue, the tenor whereof being to the effect: That whereas by inquest made by the said provost and bailies at the king’s command, and retoured to his chancery, it was found that the late Janet Holmes, daughter of Margaret Cunynghame, bearer hereof, died last vest and seized at the faith and peace of the king, in the aforesaid tenement of land, with yard, tailing rig, etc.; and that the said Margaret is lawful and nearest heir of the said Janet, her daughter, of the said tenement, which is held of the king in chief in free burgage; Therefore his Majesty commands and charges the provost and bailies of Irvine to give seizin to the said Margaret of the said subjects, in the ordinary manner, which the said bailie accordingly did, by delivery to her of earth and stone of the ground of the tenement aforesaid; whereupon the said Margaret craved from the notary one or more public instruments: These things were done on the ground of the said tenement, about the ninth hour before noon of the 23rd day of June 1618, the witnesses being, Adam Cunynghame of Merkinsch, John Montgomerie of Cockilby, John Blair, one of the last bailies of the said burgh, John Cruiks and William Cunynghame, merchants, and John Neilson, notary, co-burgesses, and William Stevinson, serjeant.

[ BLACKHOUSS is the possession of Patrick Montgomerie – This property lies in the parish of Largs, and comprehends the lands of Blackhouse, Dikes, Millrig, and St. Phillans-wcll, extending to a 10 merk land of old extent. It belonged, for some generations, to a cadet of the Montgomcrics of Skelmorlie. The first who can now be traced, was John Montgomerie, who married Margaret, daughter of Frazer of Knock. He was succeeded by his son Patrick, who, on 15th May, 1602, was retoured heir to his father in 8 bolls of meal payable annually furth of the 46s. 8d. land of Drummore , in the parish of Pierstoun. Patrick married Christian, daughter of John Shaw of Greenock, whose sister Elizabeth, was married to Hugh Montgomerie of Braidstane, who, having got a large grant of land in the north of Ireland from King James VI. went thither and settled. He was afterwards created Viscount Ardes, and his son was created Earl Mount Alexander. Patrick Montgomerie accompanied his brother-in-law to Ireland in 1605. His name occurs in Jany, 1625-26, as a creditor for the ” maill and deutie of his landes,” in the testament of Margaret Small, spouse to Robert Holme, in St. Phillans-well (Com. Rec. of Glasgow).
